Terms & Conditions

These terms apply to everyone who buys a membership, creates a memorial or visits a memorial page on Their Story.

1. About these terms

By creating an account, purchasing a package or using a memorial page you agree to these terms. If you do not accept them, please do not use the service.

To be completed by Their Story: Registered company name, company registration number, registered office address and VAT number (if VAT registered).

2. Accounts

You must be 18 or over to hold an account. You are responsible for keeping your login details secure and for activity carried out through your account. Each membership allows one memorial owner to create and manage one memorial page.

3. Memberships and packages

Memberships are one-off purchases, not subscriptions. Current packages are Standard (£100) and Premium (£150), each including a personalised QR memorial plaque and the storage allowance shown on the Memberships page. Optional upgrades and additional storage packs are available at £50. Prices include any applicable UK VAT and are shown clearly before you pay.

Payment is taken securely by Stripe. Your memorial features become available once payment is confirmed. We may change prices for future purchases, but never for a purchase you have already completed.

4. Your memorial content

You keep ownership of everything you upload. You grant us a limited licence to store, process and display that content solely to operate your memorial page as you have configured it. You confirm that you have the right to upload the content and to share images or recordings of other people who appear in it.

5. Acceptable use

Memorial pages must be used respectfully. You must not upload content that is unlawful, abusive, harassing, defamatory, infringes someone else’s rights, or misrepresents a person who has died. We may remove content or suspend an account that breaches these terms, and will contact you where it is reasonable to do so.

Visitor tributes are moderated by the memorial owner, who can hide or remove any message.

6. QR plaques and delivery

Plaques are made to order and personalised with a QR code permanently linked to your memorial page. Production begins once your memorial details are confirmed. Delivery is to the UK address you provide at checkout; please check it carefully, as we cannot change an address once a plaque has been dispatched.

7. Availability of the service

We aim to keep memorial pages available continuously, but we may need to carry out maintenance or make changes to features. We do not guarantee uninterrupted access and are not liable for temporary unavailability.

8. Closing or transferring a memorial

You can delete your memorial and account at any time from your dashboard privacy settings. Deletion permanently removes memorial content and uploaded media, so please export your data first if you wish to keep a copy. If a memorial owner dies or can no longer manage the page, contact us and we will help transfer ownership to another family member where we can reasonably verify the request.

9. Liability

Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Otherwise our total liability is limited to the amount you have paid us. We are not liable for loss of content where you have not kept your own copies, or for indirect or consequential loss.

If you are a consumer, your statutory rights under UK consumer law are not affected.

10. Refunds

Cancellations and refunds are covered by our Refund & Cancellation Policy, which forms part of these terms.

11. Governing law and contact

These terms are governed by the laws of England and Wales, and disputes are subject to the courts of England and Wales. Questions can be sent to theirstory.co.uk@gmail.com.
